Effective Use of This Website
By using the website www.theluxeflorist.com, placing an order by phone, or through any other channel, you agree to be legally bound by the Terms and Conditions set out below. Please read them carefully. If you do not accept these Terms, do not use this website or place any orders.

You must be over 18 years old and have legal authority to use a valid debit or credit card to purchase products.

 


 

1. Definitions

  • “Seller”, “we”, “our”, or “us”: Refers to The Luxe Florist Ltd, registered at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. Company No. 15328791.

  • “Customer”: The individual or entity placing an order.

  • “International Customer”: A Customer based outside of the UK.

  • “Website”: www.theluxeflorist.com, including any subdomains of fluxdefleur.com unless stated otherwise.

  • “Order”: The Customer’s request for products submitted via the Website or other accepted methods.

 


 

2. Pricing

2.1 All prices are shown in GBP (£) and include VAT (where applicable).
2.2 Prices may change without notice but will not affect confirmed orders.
2.3 If a pricing error is discovered, you will be notified and offered the choice to proceed at the correct price or cancel your order.
2.4 We are not obliged to honour obvious pricing errors that should reasonably have been recognised as incorrect.
2.5 Orders will not be processed until we receive your instructions following such notice. If we are unable to reach you, the order will be cancelled.

 


 

3. Payment

3.1 We accept payments via major credit/debit cards (Visa, MasterCard, American Express, Maestro, Visa Electron) and Klarna payment options (Pay Later, Slice It).
3.2 Payment must be made in the appropriate local currency.
3.3 Any discount codes must comply with their own specific terms.
3.4 We reserve the right to cancel orders that breach these Terms, even after payment.
3.5 Klarna’s services are governed by Klarna’s own terms. Your data will be processed according to applicable data protection laws and Klarna's privacy policy.

 


 

4. Ownership of Goods

Ownership transfers to the Customer only after full payment is received and confirmed by The Luxe Florist Ltd.

 


 

5. Orders

5.1 Orders are subject to availability and acceptance.
5.2 Receipt of an order confirmation email does not constitute order acceptance.
5.3 A binding contract is created only once your items are dispatched.
5.4 While we make every effort to secure your data, we cannot be held responsible for unauthorised access unless due to negligence.
5.5 Internet data transmission is not completely secure. Use of the Website is at your own risk.
5.6 We reserve the right to limit quantities to a maximum of 5 units per product, especially where resale is suspected.

 


 

6. Delivery

6.1 Delivery dates are indicative and not guaranteed.
6.2 We aim to dispatch within 5 working days unless otherwise stated.
6.3 If items are unavailable, we will dispatch them as soon as possible once received from our suppliers.
6.4 We are not liable for delays caused by third parties or carrier amendments.
6.5 International deliveries may incur import taxes and duties, which are your responsibility.
6.6 You are responsible for complying with the laws and regulations of your delivery country.

 


 

7. Shipping

7.1 Orders are shipped using the method selected during checkout.
7.2 Estimated shipping times are provided but not guaranteed.
7.3 If you require alternative delivery options, they must be requested at the time of order.

 


 

8. Risk

8.1 Risk transfers to you upon dispatch to the delivery address provided.
8.2 We are not liable for parcels lost due to incorrect delivery information or failed collection.
8.3 Items signed for are considered delivered. If tampering is suspected, do not sign for the parcel.

 


 

9. Title & Defects

9.1 You own the products once full payment has been received.
9.2 You must inspect goods within a reasonable timeframe.
9.3 If items are faulty or misdescribed, notify us within 24 hours for a full refund, repair, or exchange.

 


 

10. Refunds, Cancellations & Returns

10.1 Custom floral arrangements are non-refundable due to their made-to-order and perishable nature.
10.2 Slight petal cracking is normal and not a valid reason for return.
10.3 For faulty items:

  • Notify us at theluxefloristco@outlook.com within 48 hours with your order number and issue details.

  • Return items within 5 working days in original packaging.

  • Items must be unused and include all original documents.

  • Returns must be via a tracked delivery method (at your cost unless otherwise agreed).

  • Include a covering letter with order and contact details.

  • Exchanges will be processed within 48 hours of receiving returned goods.

  • Refunds will be issued within 7–10 working days if approved (minus shipping where applicable).

10.4 Goods must be returned before any refund is issued.
10.5 Discrepancies caused by us may be resolved with:

  • A full refund within 14 days, or

  • An exchange for the correct product,
    Provided the return process is followed.

11. Cancellations

11.1 Cancellations are not permitted. Order discrepancies must follow the Returns Procedure in Clause 10.
11.2 No refunds are issued for:

  • Customised products

  • Perishable items (e.g., live florals)
    11.3 If you cancel due to change of mind, a non-refundable 10% deposit will be retained to cover direct losses.

 


 

12. Liability

12.1 We are responsible only for foreseeable losses due to breach or negligence.
12.2 We are not liable for losses related to business, resale, or commercial use.
12.3 We do not limit our liability for:

  • Death or personal injury due to negligence

  • Fraud or fraudulent misrepresentation

  • Defective products under the Consumer Rights Act 2015
    12.4 Your legal rights remain unaffected.

 


 

13. Intellectual Property

13.1 All trademarks and content on the Website belong to The Luxe Florist Ltd and may not be used without permission.
13.2 No part of this website may be used commercially without a valid license.
13.3 We are not liable for any misuse of intellectual property by third parties.

 


 

14. International Customers

14.1 Customers outside the UK may pay in their local currency using international credit cards.
14.2 All other terms apply equally to international transactions.

 


 

15. Governing Law

15.1 These Terms are governed by English law and subject to the jurisdiction of the courts of England and Wales.
15.2 Fraudulent credit card activity will be prosecuted without exception
